The Process of Adjusting Your Status

Adjusting your immigration status can be lengthy and complex, requiring numerous forms and supporting documents. Below is an overview of what you may expect:

  1. You will submit a petition and a Green Card application (Form I-485) to US Citizenship and Immigration Services (USCIS). Depending on your situation, you will likely need someone else (your US citizen or lawful permanent resident sponsor) to submit the petition.  
  2. You may need to determine if a visa is available to you. This applies to those seeking adjustment of status through a family member, employer, or another applicable category. Visas for immediate family members are unlimited.    
  3. You must visit an Application Support Center (ASC) to provide biometrics (e.g., fingerprints and photos) to USCIS.  
  4. You could be called for an interview where you will answer questions under oath about your background, residence history, criminal record, and more. 
  5. Pending everything is in order, USCIS will mail you a notification of its decision on your case. If yours is approved, you will receive your Green Card later on. Should you be denied adjustment of status, your letter will explain why. Often, you can appeal a denial.
