Petitioning for a Family Visa

As a US citizen or Green Card holder, you will petition on behalf of your family member. In many cases, you must file Form I-485, Application to Register Permanent Residence or Adjust Status, and Form I-130, Petition for Alien Relative. You will also need to pay a filing fee. 

If you are the petition’s beneficiary (called the principal applicant), you must file multiple specific forms. 

These may include:

  • Form I-864, Affidavit of Support
  • Form I-693, Report of Medical Examination and Vaccination Record
  • Form I-601, Application for Waiver of Grounds of Inadmissibility (if you are currently inadmissible to the US)
  • Other documents to show you are eligible for a visa

Additionally, as the principal applicant, you will attend an interview at a US embassy or consulate in your home country. If you are already in the US, you may be able to file for an adjustment of status without leaving the country. 

After receiving all documents and conducting necessary interviews and background checks, the US government will make a decision on the visa application. If approved, your family member can obtain a Green Card or relevant family visa.

    Bringing a Fiancé(e) to the US? Here Is What to Know. 

    You may be able to bring your future spouse to the US through a K-1 fiancé(e) visa. Here is what to know about this type of visa: 

    • You must be a US citizen and plan to get married within 90 days of your fiancé(e)’s arrival
    • Your fiancé(e)’s children may also receive visas if they are accompanying your fiancé(e)
    • After marriage, your spouse can apply for adjustment of status to become a lawful permanent resident

    Are you already legally married? You cannot bring your spouse to the US through a fiancé(e) visa. Instead, you would need to seek a family visa. The type you can obtain will depend on whether you are a US citizen or a Green Card holder.
